Litigation

Since its inception as a civil litigation law firm, litigation continues to be an important focus for the firm. Our litigation attorneys and staff are some of the most knowledgeable in the field representing mortgage bankers and the legal issues that affect them. This department handles all adversary proceedings, contested foreclosures and negotiates settlements between homeowner/ homeowner attorneys and clients.

The litigators in this department have represented the interests of the mortgage banker before the Federal government in forfeiture actions, eminent domain matters, and tort litigation as well as representing the mortgage banker in defense of TILA, RESPA and other federal statutes that govern the mortgage banking industry.

To assist in efficiently handling those foreclosure files wherein allegations are raised which may affect the successful entry of a final judgment, a committee comprised of litigation and foreclosure attorneys reviews all defendant/mortgagor responses to determine if the matter is truly litigated.

As part of our client support program, we provide ongoing reporting regarding status and management of the litigation process. For more information about the technology that is incorporated into our client services, please click here.
